This policy aims to explain how Community Crisis Care use your personal data.

It is the personal responsibility of every individual referring to this policy to ensure that they are viewing the latest version.

Introduction

The Data Protection Act 2018 controls how your personal information is used by organisations, businesses or the government. The Data Protection Act 2018 is the UK’s implementation of the General Data Protection Regulation (GDPR).

This privacy notice describes how we will collect and use personal information about our employees and applicants who apply for positions with us.

Community Crisis Care is the “data controller”. We are responsible for deciding how we hold and use personal information about you. We are required under data protection law to tell you about what information we process about you. Personal information does not include data where the identity has been removed (anonymous data).

How is your personal information collected?

We collect personal information about our employees through the recruitment process and on an on-going basis whilst in our employment. This information normally comes direct from the employee or job applicant or sometimes from an employment agency or background check provider. We may sometimes collect additional information from third parties including former employers, credit reference agencies or other background check agencies.

How we will use information about you

We will only use your personal information when the law allows us to. Most commonly, we will use
your personal information in the following circumstances:

We need the categories of information above to allow us to perform our contract with you or take specific steps before entering into a contract and to enable us to comply with our legal obligations. We will also need to up-date the information we hold about you during your employment. The situations in which we will process your personal information are listed below.

Some of the above grounds for processing will overlap and there may be several grounds which justify our use of your personal information.

If you fail to provide personal information

If you fail to provide certain information when requested, we may not be able to take specific steps before entering into a contract (such as considering your application or making an offer), or we may be prevented from complying with our legal obligations

We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Do we need you consent?

We do not need your consent if we use special categories of your personal information in accordance with our safer recruitment policy to carry our legal obligations

Information about criminal convictions

Where appropriate, we will collect information about criminal convictions as part of the recruitment process or when we complete DBS checks for our regulatory compliance or we may be notified of such information directly by you.

Less commonly, we may use information relating to criminal convictions where it is necessary in relation to legal claims, where it is necessary to protect your interests (or someone else’s interests) and you are not capable of giving consent, or where you have already made the information public.

Data sharing

We may have to share your data with third parties. Where this is done we require third parties to respect the security of your data and to treat it in accordance with the law.

Security of your data

We will ensure that appropriate measures are taken against unlawful or unauthorised processing or personal data, and against the accidental loss of, or damage to, personal data. Third parties will only process your personal information on our instructions and where they have agreed to treat the information confidentially and to keep it safe.

Where we store your personal data

The information we process about you is held securely at the particular site where you work or securely at our head offices in Morden and Kenley.

Retention of your records

We will not keep your personal data for longer than is necessary for the purpose. Records relating to successful candidates will be placed in their individual personnel file. Records for unsuccessful candidates will be held for 6 months and then securely and safely destroyed.

Your duty to inform us of changes

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes.

Your rights in connection with personal information

If you want to review, verify, correct or request erasure of your personal information, object to the processing of your persona data, or request that we transfer a copy of personal information to another party, please contact the Data Protection Officer in writing. No fee usually required

You will not normally be required to pay a fee to access your personal information. However, we may charge a reasonable fee if your request for access is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances

We may need to verify your identify in order for you to access your personal information.

Right to withdraw consent

To withdraw your consent, please contact the Data Protection Officer. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have legitimate legal basis to do so.

You have the right to make a compliant at any time to the ICO, the UK supervisory authority for data protection issues.
